TERMS AND CONDITIONS:
- An Order placed by the Buyer in terms of this quotation shall constitute a binding contract and the Buyer shall be deemed to have agreed to the terms and conditions
referred to in this quotation.
- All orders require payment before delivery, unless otherwise agreed in writing.
- Ownership in goods sold is reserved to Jachart (Pty) Ltd t/a Ehad (the Seller) until fully paid for, notwithstanding delivery.
- In the event of the Seller agreeing to a cancellation of the sale after placement of order, the Seller shall be entitled to a handling fee of 10 % of the purchase price.
- This quote is subject to the availability of stock.
- Installation, calibration or any training required with respect to any equipment is not included in the quotation unless specifically stated otherwise.
- This quote is valid for seven days, unless otherwise stated.
- VAT will be charged on all export orders unless they are consigned to the Buyer via the Seller’s Freight Forwarding Agent, or if the Seller is contacted by the Buyer’s approved and registered Freight Forwarding Agent so that the Seller can arrange the necessary export documentation before dispatch of goods. VAT will be charged to the Buyer when the Buyer collects in its personal capacity.
- In the event of the quotation not quoting for transportation, the goods are to be collected in East London at the Seller’s premises. Delivery is deemed to have taken place at the Seller’s premises in East London. The transporter who collects goods for the Buyer from the Seller’s East London premises is deemed to be the transporter of the Buyer and risk in the goods purchased is deemed to be transferred to the Buyer upon delivery to the transporter, whether or not the transport was arranged by the Seller. The Seller shall not be responsible for any goods lost or damaged in transit and the Buyer shall have no claim against the Seller in respect thereof. The Buyer shall be responsible for its own insurance of the goods while in transit, and any claims for lost or damaged goods in transport will rest with the Buyer and the transporter, irrespective of who arranged for the transporter used.
- The Seller does not warrant that the goods sold are suitable for the purposes intended by the Buyer, and it is the Buyer’s responsibility to satisfy itself that the goods sold are suitable for its purposes.
- The Buyer shall not be liable for any consequential loss suffered by the Buyer, howsoever caused, whether due to malfunction in any way or breakdown completely. It is the responsibility of the Buyer to ensure, at the time of making payment, that the goods quoted for are available in the stockholding of the Seller. If not, the Seller may need to order in the stock from its supplier. In the event of the Buyer paying a holding deposit for goods ordered in terms of the quotation, the Seller shall be entitled to deduct a 35 % holding fee in the event of the Buyer requesting a refund, due to the fact that the Seller held the stock back on behalf of the Buyer which could otherwise have been sold by the Seller. Where the Buyer pays a holding deposit for goods, specifically ordered in terms of a Special Order from the Seller’s suppliers, the Seller will not receive a refund as the Seller is unable to return the goods to its supplier in the event of the Buyer no longer requiring the goods and requesting a refund. In this event the holding deposit is non-refundable. In the event of a holding deposit being refunded and agreed to by the Seller, the Buyer must submit in writing proof of the bank account to be refunded with attached proof of deposit, which bank account must be the same bank account from which payment was made by the Buyer to the Seller.
- The relevant manufacturers warrantee will apply to the type of product sold. Details of the manufacturer’s warrantees can be obtained upon request or on the Seller’s website www.ehad.co.za.
- Jachart (Pty) Ltd t/a Ehad – Warranty Agreement for South Africa:-
13.1 Jachart (Pty) Ltd t/a Ehad warrants the EHAD S-Series retail / commercial – New Pump and Dispensers are free from defects in design, material and workmanship under normal use and service for 12 months starting from the date of invoice. New equipment installation must be registered in EHAD by returning this signed warranty agreement within 30 days to receive warranty benefits.
13.2 This warranty excludes nonreusable breakaways, emergency shut off valve, hose and nozzles, filter and its strainer, belt, blade for vane pumping unit as well as other graphic materials specified by customer. Components specified by customers may be warranted by their original manufacturers.
13.3 The distributor or authorised representative will repair or replace parts of equipment found to be defective in material or workmanship at its own sole judgment during the warranty period by supplying new or rebuilt parts at its option. Parts under the coverage of this policy, if requested by EHAD, shall be returned to EHAD with freight prepaid. The replacement parts shall be sent from EHAD.
13.4 The warranties, as set forth above, are made expressly in lieu of all other warranties, either express or implied, including, without limitation, warranties of merchantability and fitness for any particular purpose and of all other obligations or liabilities on our part. Further, we neither assume, nor authorise, any other person to assume for us, any other liability in connection with the sale of the all petroleum equipment products which has been subject to accident, negligence, alteration, abuse, or misuse, or which has been subject to any damage from any act of nature or any force majeure.
13.5 The sole liability of EHAD for any breach of warranty shall be as set forth above. EHAD do not warrant against the modification done by customers themselves and damage caused by accident, abuse, faulty, improper installation or operation. In no event shall Jachart (Pty) Ltd t/a EHAD be liable for any direct, indirect, incidental or consequential damage or loss of product.
